[ ♪ music ♪ ] >> michael: scandal week came in with a bang, but if the president has his way it will go out with a whimper. the president forcefully

responded to the flood of republican attacks. let's start with the latest coming from house speaker john boehner and senator marco rubio. >> nothing dissolves the bonds between the people and their government like the arrogance of power here in washington. that's what the american people are seeing today from the obama administration. remarkable arrogance. >> the president doesn't have clean hands in this. as i said yesterday on the floor of the senate this organization of his this administration has created a culture of intimidation. >> michael: well, all of that stirring rhetoric ran up against the president's clear resolve at his press conference today. he answered a question about the irs targeting conservative groups by calling for more action even after the head of the irs stephen miller resigned yet. >> obama: it doesn't matter if you're democrat or republican, you should be equally outraged at even the prospect of the irs might not be acting with the

kind of complete neutrality that we expect. i think we're going to be able to fix it. we'll get there and get it done, and we've already begun that process. we'll keep on going until it's finished. >> michael: we all loved watching the marine holding the president and prime minister. that was attention getting at the rose garden. the senior official at the office of management and budget will step in as acting director of the irs starting next week. the democrats seem to be regaining the political narrative today. today nancy pelosi placed it squarely on the supreme court's citizen united decision. >> the actions highlight why we must overturn citizens united. as you know a very thin line we must pass a law that makes it much clearer that the so-called

social organizations would like to make their priorities promoting social welfare rather than engaging in politics. >> michael: now to the second, quote, big scandal of the week: benghazi. the white house released 100 pages of e-mails following the attack. that seems to have taken some of the wind out of the republicans' sail. then the president called on congress to stop using the issue as a political weapon and concentrate on protecting our embassies. >> i want to say to members of congress in both parties. we need to come together and truly honor the sacrifice of those four courageous americans and better security our diplomats around the world. i should add by the way we're getting help from the turkish government on some of these issues. that's how we keep faith with the men and women whom we send overseas to represent america.

and that's as commander of chief chief. >> michael: republicans can prove they're serious to preventing another benghazi by getting behind the security bill. >> as chairman of the foreign relations committee outrages that we in the senate have not done enough to investigate what has happened in benghazi. if you want to address the problem, we have an opportunity to do it. if you want to score political points fine. but do not do it at the risk of american lives. let's work together to fix the problem. not use it for political advantage. >> michael: and we are seeing action. a state department spokesman announced today 48 new diplomat diplomaticdiplomatic security officers will start in july and another 48 in september. court jesters michelle bachmann and louis gohmert called a press

conference about the irs. she worked as a tax lawyer leveling tax for the irs. today she suggested that the president should be impeached over the scandal. >> i will tell you as i have been home in my district and the fifth district of minnesota there isn't a weekend that hasn't gone by that someone says to me, michelle, what in the world are you all waiting for in congress? why aren't you impeaching the president? he has been making unconstitutional actions since he came into office. >> michael: why would anybody take those people seriously? they sent michelle bachmann to the congress. then there is louis gohmert. the king of unintentional comedy. the not only wants impeachment but a revolution. >> this is a government run amok. why would you want legal status? because this is the way a tyrannical government comes into

being and perpetuates itself. >> michael: next up for republicans squeezing every last bit of juice out of the scandals to thwart the president's agenda. in a hearing today the republicans accused the epa of unfairly targeting conservative groups for environmental review and compared that to what the irs is doing. they haven't confirmed the president's nominee the head of the epa and you don't have to be at louis gohmert level genius that they're going to stop her from being confirmed. mainstream republicans seem to be getting nervous about making too much of it. "national review" preached caution writing democratic scandal does not take the place of a republican agenda. for once the "national review" might actually be on to something. joining me now, joan walsh editor at large for salon.com. and author of the book "what's the matter with white people."

she is coming to us from new york. thanks for coming into "the war room"." >> thanks for having me. >> michael: it's a pleasure to have you on the show, and there is so much to talk about. but as we near the end of this fabulous week how would you rate the white house's performance in the way they've dealt with all of these scandals this week's? >> you know, michael there is a part of me that resists rating their performance. there is only one scandal in my mind, and that is the questions around what the department of justice are doing with the ap records. the other two are faux scandals. they're made up,, and con confectionary can exactlies acting as if president obama is culpable and if he acted tougher, earlier or got the e-mails out sooner he could have some how for stalled this. i'm sure there are things along the way that he could have done, and we can talk about some of them, but really this is what republicans do.

they're about to have a civil war over immigration. instead they're having a circular firing squad. them what they did in the 90s to bill clinton, and hey, let's have scandal fun. is the white house reaction perfect? now. is the congressional reaction perfect welcome they're late to defend the president, some of them. the important actors, though, really are the media. >> michael: let's talk about what you brought up with the ap and the department of justice. i mean, where do you--to extrapolate from the title of your book, what is the matter with white house house? is this something in your estimation have done a good job responding? hehe talked about it yesterday, he talked about it today. is this a response that services you or is it going to go on and on now. >> no, i'm not satisfied with

his response. he has had a hard time with republicans getting his agenda through, nevertheless he got some really good things done. it's really his national security policies and the continuation quite frankly of push policies is the one area where i really do give him low marks. both he and eric holder are telling us that we have scary people out there and if we knew what they knew, maybe we would be happy to give up all our rights but that's what bush and cheney did. i'm not comfortable with the extent we are relying on we have really bad enemies and we're going to do everything we can to keep you safe. there are big questions about whether the department of justice went to far when weather there are other ways to get the record, and they are resisting answering questions at this point. >> michael: yes, it leaves a lot of journalists very uncomfortable. but that point exactly. i think that's going to stake. i think a lot of people in the

irs think it's going to stick. let's move on. the "national review"," democratic scandal does not take the place of a republican agenda. how do these scandals impact the elections if at all? >> well, i hope that we can look back to 1998 as an example because it was that rare second term midterm where the president's party held power and gained seats because the republicans overreached. people were sick of newt gringrich. people were sick of republicans impeaching a president over an extramarital dalliance when they were all doing the same thing. we may see that. it's kind of early. but the other thing people are saying, the president what is going to happen to his agenda? his agenda was always in the hands of the people who want to block it. so you know, it's possible that the american people will perceive this as an overhe reach on the part of the republicans. but you know, i'm still waiting

to see how that plays out. it's two early to push it to one side or the other. >> michael: i love the way you put it. the people have complained about the president not getting enough done. president obama's agenda was always in the hands of the people who want to block it. that's a great way of putting it. your book, what's the matter with white people look at the rise of the tea party and the resurgence of racism in america. do you think it could come back to hurt he republicans? >> i hope so. i hope there is a backlash at the perceived unfairness. the blocking of the president's agenda is refuseing to confirm anyone. they have just played it their business. they won't confirm anybody. he tries to put in appointments. apparently the judge had a problem with that, so he's back to square one, and you know, i hope the american people can see

who the problem is, but to get to what the president doesn't always do right, i don't think he completely communicates clearly to what he's up against. pursuing a grand bargain and thinking that his legacy is going to lie with some how making these guys have a fairer tax code if only he compromises a little bit on entitlements which he should not. and they weren't interested in that. you know he's got to get back on his game, talking about jobs and telling people what he's up against. >> michael: my fear is if he is distract--the problem with getting back on his game because his game for a long time was that grand bargain. to think that he was playing a great game of chess and thought that they called his bluff. i know you disagree with me as do a lot of very smart people

putting me in an untenable position. >> you never know. >> michael: never proven. before i let you go, i mean, you've gone on the ap story. i want to talk to you one more thing, i was thinking about this, at the inbeginning of the week people on both sides of the aisle people were calling for eric holder's resignation. has holder weathered the storm? i thought he was going to leave soon any ways. is he going to stay on longer because of this? >> i'm so torn about eric holder. he has done so many good things about civil rights enforcement and he was brave to push back on the disinfrance chiasing, and the voteer suppression and beefed up civil rights. i loved seeing him go off on the house committee yesterday. you rarely see that. i was just cheering him on. on the other hand, what they did with the ap is not a good thing and i think his handling of was

well i recused myself, but on the other hand these were scary threats and i have perfect faith in my department. either recuse yourself and don't talk about it or talk about it. i'm on the fence with that one. it's another thing where the president is inclined to fight for him because of the way they have singled him out from fast and furious. you go back, and you look at--they really try to make scapegoats out of a lot of african-americans. eric holder, susan rice, jones there has got to be a part in the president where he says not this time. that makes me root for eric holder. >> michael: it's a really good point. the book is called "what's the matter with white people," joan walsh, thank you for being in "the war room." we go to the real purpose of the president's press conference was to talk about syria. he was joined by themore than 400,000

refugees are in turkey and that number is estimated to rise to a million by the end of the year. the president offered his support. >> under the prime prime minister's leadership, i know this is a heavy burden. i made it clear that the united states is going to keep on helping the region, including turkey shoulder this burden doing our part as a major donor of humanitarian aid to the people of turkey. >> michael: and finally to news here at home. a mild wide tornado hid texas killing six people and injuring more than 50. a local texan described the scene here. >> everything is demolished. >> what was it like when it hit?

>> hell. >> michael: more than 100 homes were damaged and dozens of people are missing. it's worth a mention that this tragedy occurred in the district of representative bill flores. west texas fertilizer fire also in his district. it is worth mention the congressman voted against the desperately needed hurricane sandy package. they should get the need that it so badly needs because the government's role is to take care of the people. congressman flores you are a hypocrite. but even a hypocrite can learn a lesson, and i hope that you do, and we're happy to help. that's what a patriot does. jacki spear will talk to us

>> michael: the military is being rocked by sexual assault epidemic. today kristin gillibrand said she would move a bill take a look. >> when a person in charge preventing sexual assault in the regs is himself arrested on alleged sexual assault clearly we have a strategy in place that is not working. twice in just one week this has

happened. when any single victim of sexual assault is forced to salute her attacker clearly our system is broken. >> michael: that is powerful. on tuesday it was revealed the army is now investigating a sergeant first class over allegations of sexual misconduct and forcing one sub ordinance into prostitution. secretary chuck hagel is ordering the re-screening of all military recruiting and sexual assault officers which is in the tens of thousands of soldiers. this comes two weeks an lt. col. was arrested on charges of groping and battering a woman in the pentagon parking lot. he was in charge of the sexual assault prevention program. today the president is meeting

secretary chuck hagel to discuss the--the crisis. joining us now from washington, d.c. from the capitalcapitol. thank you for joining us. >> thank you for having me. >> michael: aside from gillibrand's new legislation you have your own bill in congress now, the stop act. what will it take congress to really act? >> i think that there is such growing momentum now that i'm optimistic that we are going to be successful at least at getting amendments from the national authorization act. it's very hard to go up against the military. if you question them you're seen as unpatriotic even though we have an obligation to make sure that everyone in the military is

safe, that they're not going to be subject to sexual predators and that's the situation today. under the chain of command if you're rape or sexual assaulted you're expected to go to your commander and file a complaint. sometimes your commander may be the actual assailant or friend of the assailant or the commander may be looking for a promotion and fears that the sexual assault becomes public it will keep him from being promoted. as a result, what happens those who complain, those who decide to come forward are typically found to be suffering from a personality disorder. that's really the label they give them. and then they are discharged from the military honorably but involuntarily. that's why when there are 26,000 sexual salts and rapes that occur in the military every year but only 3,000 of them

actually reported it's because they know it's a career ender. if they do report, the likelihood of they being able to stay in the military is remote. >> michael: we talked about scandals drummed up scandals. this america this a scandal. this is scandalous. tell me something congresswoman, you're in the house. there are former military members who are now in congress. what is their take on this? >> well actually, some of the retired military that are now members of congress understand the dynamics. frankly some of those who have never served that don't understand the dynamics. i think that what is really critical here is for us to appreciate that you have to protect all of the members of the military. and the fact that we have actually appointed individuals to be the sexual assault prevention officers in the

number of the services who then have gone on and become sexual predators, it's suggesting i think to all of us that the military doesn't have it right. the reason why i think congress comes enablers there have been plenty of sex scandals in the military over 25 years. there was pail hook. there was the academy can exactlies around rape. there was recently lack land air force base where training instructors were preying on new recruits. it goes on under our noses, and we find it appropriate to just allow the military to offer up yet another prevention program or training program, and some how they're going to fix it. well they don't fix it. >> michael: we heard pre-training re-screening, and recredentialing. >> i talked with the secretary as recently as last night and they're committed to fix this problem but we're not going to

train ourselves out of this problem. it's a cultural problem. until heads roll, until individuals who conduct themselves in that fashion are court-martialed and kicked out of the military this will continue to go on. in the private sector if you sexually harass someone they fire you. if you sexually assault someone you're fired and you're charged with a crime and probably will serve time in prison. there is a system in place in the military where it's closed much like the catholic church is, and they play by a different set of rules. it's time for us to put the word justice back into the military. >> michael: we're certainly glad congresswoman jacki speier, that you're out there to try to change those rules. i heard you've been receiving threats to end the military sexual assault. is this through? >> it is true.

it's being investigated by the police. if they warrant additional review there will be steps taken. mostly i am concerned with the fact that the facebook pages that i was made aware of was by a whistle blower. i alerted secretary hagel because i was concerned not with the free speech component. everybody has a right to say and do whatever they want, but if they're using taxpayer funded servers and doing it on tax taxpayer time they should be held accountable. >> michael: stay safe and keep fighting. we appreciate you up there in washington. up next in "the war room," a thing or two about the white house's relationship with the media. the heart of the pentagon paper heirs case, and he will join us next.

[ ♪ theme music ♪ ] >> michael: the justice department seizure of ap phone records has outraged defenders of the first amendment. among them is james george counsel of the "new york times" when president richard nixon ordered the old gray lady to cease publication of the pentagon papers detailing america's involvement in the vietnam war and published excerpts that shows the american government in less than favorable light. but as counsel for the times goodell argued that publication of the pentagon papers fell under the freedom protected of the first amendment. judge murray gurfein wrote this. : what a beautiful way of

putting it. the supreme court ultimately agreed 6-3. but as recent events have shown president obama does not suffer a con con con tankerrous press james goodell published a memoir of his time called "fighting for the press." he joins us tonight from new york city. welcome to "the war room," james. >> thank you glad to be here. >> michael: we are certainly glad to have you. let's go back to june 13, 1971 when president nixon first learned go the papers leak. here are excerpts from that phone call. >> nothing else. >> very significant this goddamn "new york times" exposé most highly classified documents

of the war. >> oh, that, i see. i didn't read the story but you mean that was leaked out of the pentagon? >> this is a devastating security breach. >> will the me ask you this. what about it, what is are they going to do it i would start at the top and fire some people. whatever department came out i'd fire the top guy. >> michael: he's talking about melvin laird, the secretary of defense at the time. james, you said that when it comes to national security and handling the press obama is worse than nixon. obama has indicted six people for security leaks. is what makes him worse than nixon? >> he's getting close to being worse than nixon. overall, but in this area he is worse than nixon. nixon indicted only one person

and that was the first person ever so inindicted. and then there were two more since obama came in. and a total of three is all we've ever had in this country. what obama has done, he has indicted six. he's head 6-3. but the three encompasses three and the six from obama. he's worse than nixon. >> michael: there is not an american president alive who would like to be compared to richard nixon. >> no, i want to say that we're talking about national security leaks here. this is where obama is challenging nixon for the lead. there is a big difference between obama and nixon to the extent that nixon wanted to destroy the press, and obama in this area are pretty good. but this part, he ain't so good. >> michael: that's becoming even more clear when you read and

listen to what you've got to say the president was asked by a reporter today in the rose garden about that comparison. let's listen to him. >> how do you feel about comparison of some of your critics of this week's scandals and some of those in the nixon administration. >> i will let you engage in those comparisons. i make no apologies and i don't expect america to expect me, commander in chief to be engage in situations that might get them killed. >> michael: does he owe us an apology. >> that was about about wikileaks. with respect to what he says about wikileaks i hadn't heard that quote before. i'm disturbed about that because part of the clarion message in

my book is watch out for obama on julian assange and wikileaks. if he prosecutes julian assange he will be worse than nixon, and what he says there does not give me any confidence whatsoever. >> michael: you bring up wikileaks and julian assange. the media does not consider him as one of their own and could care less about what happens to him. but a successful prosecution of assange could set a precedent for weakening the press. why is that? >> what assange would be prosecuted for is publication. what nixon did was he stopped the presses from running. that's called censor ship. then he tried to prosecute "the new york times" and it's reporter but failed.

so now obama is trying to do something that nixon could never do. if obama is able to prosecute people who publish, that means he can go after you. right now you're publishing stuff, broadcasting but it's the same sort of thing. and after you broadcast it, or after you publish it in the case of julian assange, he's going to come around and prosecute you. if he's able to prosecute assange for publishing, that means you're at risk for broadcasting and the new york sometimes is at risk for publishing. it's never happened before. it's an entirely new thing and it's very frightening. >> michael: if that's the case, i better disagree with you on everything. >> go ahead. >> michael: you're totally wrong, james, i don't know what you're thinking. thinking. >> michael: most states have state laws that protect their journalists. there is no federal shield law and some journalists have gone to jail before. he has actually backed away from that. why would he have done that? >> after he became president after supporting as a senator he decideed that national security should trump the reporter's rights to keep sources secret. he has indicated so doing that it's a national security hawk. when he put that in this bill, by the way, there is a very good bill that protected reporters that passed overwhelmingly in the house. obama said good bill. he comes in as president, no good bill. he has the national security step in. which means you have to cough up your sources if there is a claim of national security as there is in the ap situation. so when that went to the senate,

first of call he said he was for it then he kills it. why was he in favor that have. >> michael: now he says to chuck schumer that he wants to reintroduce the same shield law. >> yes, it's the same law. >> michael: it's a watered down shield law. >> beware to everybody. >> michael: he's shielding himself. he's trying to shield himself. >> hey listen, he's saying, look, this is a problem. here is my solution. guess what, it's the same solution you killed before with that terrible provision. so we're getting nowhere. >> michael: that's the big problem right there. james goodale is called "fighting for the press." you're all going to want to read it. thank you for being here on "the war room." up next, the meddling koch brothers are hatching a plot to

that i'm going to be the first one to call them out. they can question whether i'm right, but i think that the audience gets that this guy, to the best of his ability, is trying to look out for us. >> michael: we all know it's been a rough week for the white house, but it's been even worse if you were glued to fox news. well, most things are worse when you're glued to fox news. >> there is more breaking news. new reports the white house is damage control mode as potential scandal keep piling up from benghazi and the talking points of the irs controversy and the administration trying to avoid bash lash. >> well, i think the strategy here is if you are inside the white house yesterday its chaos right? let's confuse the american

public. >> president obama is facing a buy rage of questions on a trifecta of scandal. >> michael: trifecta of scandal. imagine if that tone ended up on the door stoops of millions of americans. it's been widely reported that the right wing money men david and charles koch, are looking into buying the tribune company company's newspaper business. from los angeles to chicago to orlando tribune boasts it's papers are read by more than 5 million people on weekdays and more than 8 million people on sundays. all combined it's papers have the fourth largest daily circulation in the country. now the koch brothers want to get in the news businesses, but they are already in the manipulation business. one year ago they made a name for themselves when their american for prosperity super pac produced one of the most blatantly false ads in campaign. >> fact, billions of taxpayers dollars spent on green energy went to jobs in foreign

countries. the obama administration admitted the truth that $2.3 billion in tax credits went overseas. >> trashing green energy policy and project. fortunately in this war room there is a campaign to prevent the koch brother takeover. to save the tribune and keep it out of the hands of the koch brothers. daniel the founder of forecast effect. you are basically a group that is about climate change awareness. tell us how finding the kochs and their purchase of the tribune company works in concert with your stated mission. >> sure, and thanks for having me. there is a lot of groups fighting back against this, and that's because there are a lot of reasons to be worried about the koch brothers owning the

tribune company papers. they're anti-union. they're anti-government they're anti-regulation. the biggest concern is they're anti-fact. the best place to see that is the work they've done around climate change. they're two of the biggest funders of climate change deniers, promoting the idea that climate change is not happening or that it's caused by fossil fuels. the reason why is they make most of their oil off of oil and gas. they own refineries, pipelines and chemical companies. they've shown when facts get in the way of their profits they're willing to mislead the american public. those are not the kind of people who should own the tribune papers. >> their profits? we know how important their profits mean to them.

respect they taking a risk as a business endeavor if they change it to right wing rags? >> if you look at what the tribune company does they recognize their newspapers have a public interest. they have to appreciate that the koch brothers would not be pursuing that same public interest. that's why you have 250,000 people who have called on the tribune company not to make the sail thousands of subscribers say they will immediately cancel their subscription. i think there is a threat to the bottom line. and the reputation. if "the l.a. times" is turned into a right wing outlet it is no longer "the l.a. times" as we know it, and i don't think it will have the same value. another part of it, the industry is not a booming industry right now. and for them to buy an industry that is dieing in some places i find it question edge on the

stand point of them being businessmen. >> it is a business that is facing high school challenges, and some of the speculation is that the koch brothers would be less sensitive to that because they're less interested in it from a business point of view, and more from an ideological point of view and from helping their bottom line in terms of controlling with the media narrative around climate change, healthcare. but there are other buyers offering for "the l.a. times" and other papers who do want to see these continue as the important journalistic institutions that they are. oak tree capitol manages a number of pension there is. two days ago, the of the afl/cio boss:

boss:how much support are you getting. >> the unions have been active on this boast in terms of expressing their displeasure. they've been holding protests, in chicago the tribune company in los angeles, orlando. there will be a national day of action coordinated with all of the groups that are working on this on may 30th. the union have really been bringing their efforts to bear. oak tree capitol own 23% of the tribune company stock. they are the ones who have to decide what should happen to these papers and certainly the financial issue will be an important one but they also have a public issue here as well. >> michael: is part of your effort and the groups that are with you is part of the effort to buy a buyer that is newspaper friendly or neutral at the very least? >> we're trying to connect with groups out there. one of the groups eli broad in

los angeles. one of the tricky things the tribune company has expressed a desire to sell all the papers at once. it's possible that there would be buyers who come in sand say i would like to buy the the baltimore sun. >> michael: we hope that that's a decision that they have, that they find someone to do that. thankthank you for fighting the kochs every dayment. in new hampshire live free or die. we'll check in on the free state movement right after this. you know who is coming on to me now? you know the kind of guys that do reverse mortgage commercials? those types are coming on to me all the time now. right to unionize and a raise of the minimum wage up to $15 an hour. these demonstrations are having an impact in new york, half of the 70 restaurant affected by walkouts last november have boosted wages from anywhere between $0.25 and $2 an hour. eric schneiderman has taken owe notice. the attorney general's office has started investigating whether owners of fast food employers paid less than minimum wage or did not pay overtime or even falsified payroll records. from fast food strikers in milwaukee to merry pranksters in keene, new hampshire, a group of men and women dubbed the robin hood of keene have been patrolling the city to help people avoid parking tickets feeding meters just ahead of law enforcement. >> we found that people really appreciate it when you save them from a ticket when you fill their meters.
